Senior Stays believes in secure eCommerce. Seniorstays cannot guarantee that your business will be successful and cannot refund for a business after it has gone live on the web. Senior Stays has a resolution process that must be exhausted before any refunds are issued. All refund applications will be carefully considered and given at the discretion of the Company Management.
Your contract with Senior Stays is for a minimum period of 12 months. If it is not terminated for an acceptable reason agreed to by Management then it automatically renews for further 12 month periods on each anniversary of you agreeing to its terms (i.e. the date you made your application). If you wish to terminate your contract you should give us written notice at least 30 days before the annual renewal date of your contract with us. If you fail to send us this notice of termination your contract is automatically renewed and you shall become liable for the next annual fee in full, within the discretion of Senior Stays Management.
These terms and conditions (‘Terms’) apply to all advertising services provided to any person (‘Customer’) by Senior Stays.
Publication of Advertising
Subject to these Terms, Senior Stays will use its reasonable endeavours to publish advertising submitted by Customers (‘Advertising’) in the format submitted by the Customer and in accordance with the placement instructions of the Customer.
Right to Vary Format and Placement
Senior Stays reserves the right to vary the placement of Advertising within the site; and Senior Stays will endeavour to notify the Customer of any such changes. However, Senior Stays will not be liable for any costs, expenses, losses or damages suffered or incurred by a Customer arising from Senior Stays failure to publish Advertising in accordance with a Customer’s request.
Submission of Advertising
By submitting Advertising for publication, the Customer warrants to Senior Stays that the Advertising does not breach or infringe:
- – the Trade Practices Act (Cth), Fair Trading Acts (State) and equivalent legislation;
- – State and Commonwealth anti-discrimination legislation
- – any copyright, trade mark or obligation of confidentiality
- – any law of defamation or obscenity
- – any law of contempt of any court, tribunal or royal commission
- – the Privacy Act (Cth); and
- – any other law (including but not limited to any common law, statute, delegated legislation, rule and ordinance of the Commonwealth or any State or Territory).
The Customer must not submit Advertising for publication that contains contact details for the Customer if those contact details do not include the full name and street address of the Customer. Post office box and email addresses alone are insufficient.
For online banner and display Advertising, the Customer must;
- – confirm all online Advertising at least 7 days before the Advertising is scheduled to appear, by submitting a signed ‘Advertising Confirmation’ form to Senior Stays;
- – cancel online Advertising in writing at least 30 days before the Advertising is scheduled to appear. Senior Stays reserves the right to charge the Customer for online Advertising cancelled on less than 30 days notice.
For online banner and display Advertising, the Customer must submit creative materials and a click-through URL for online Advertising to Digital Management Systems at least 3 working days (5 working days for non-gif material) before the Advertising is scheduled to appear.
All online Advertising (including rich media) must comply with Seniors Stays advertising specifications, which are available on request.
Senior Stays will measure online display and banner Advertising (including impressions delivered and clicks achieved) through its own adserving systems. Results from Customer or third party adservers will not be accepted for the purposes of Senior Stays billing and assessment of Advertising.
Senior Stays is not liable for any loss, damages or liabilities arising from a failure of the World Wide Web or any telecommunications structure.
Customer acknowledges that Seniorstays Pty Ltd may at its discretion include additional features or inclusions such as third party advertisements within online classified Advertising.
The Customer must promptly
- – check proofs of Advertising provided to the Customer by Senior Stays
- – notify Senior Stays of any errors in the proofs or any published Advertising
Senior Stays does not accept responsibility for any errors in print Advertising placed over the telephone.
If a Customer wishes to make a claim on Senior Stays for credit, re-publication or any other remedy in respect of Advertising, the Customer must send the claim in writing to Senior Stays no later than 25 days after the date of the tax invoice or date of publication of the Advertising (whichever is earlier).
Senior Stays will only investigate complaints during normal office hours (9am to 5pm, Monday to Friday excluding public holidays)
The Customer acknowledges that it has not relied on any advice given or representation made by or on behalf of Senior Stays in connection with the Advertising.
You expressly agree that use of the service is at your own risk. Neither Senior Stays nor any of its affliliates, employees, agents, partners, content providers or licensors, make any representations or warranties of any kind regarding the service, the content, any advertising material or the results that may be obtained from use of the service.
To the maximum extent permitted by law, Senior Stays disclaims all liability and responsibility for any direct or indirect loss or damage which may be suffered by any recipient, or any other person, through relying on anything contained in or omitted from the site.
Senior Stays provides a service to managers, agents and owners of properties, and advertisers. It relies on information provided by them and to the extent that liability cannot be lawfully excluded, users and visitors agree to hold Senior Stays harmless and agree to take any action against the respective manager, agent, owner or advertiser.
Senior Stays collects a Customer’s personal information to provide the Advertising services to the Customer and for invoicing purposes. Senior Stays may disclose this personal information to its related companies and to credit reporting agencies as part of provision of the Advertising. Where a Customer has an overdue account, Senior Stays may disclose personal information to debt collection agencies to recover the amount due.
Customers may gain access to their personal information by writing to or emailing Senior Stays
These Terms represent the entire agreement of the Customer and Senior Stays in relation to Advertising and cannot be varied except in writing by an authorised officer of Senior Stays. No purchase order or other document issued by the Customer will vary these Terms.
Senior stays will not be liable for any delay or failure to publish Advertising caused by a factor outside Senior Stays reasonable control (including but not limited to any Act of God, war, breakdown of plant, industrial dispute, electricity failure, governmental or legal restraint).
Senior Stays reserves the right at its discretion to change these Terms of Service and will notify users of any such changes by online postings.
